GENERAL

1) These General Terms and Conditions (“Ts & Cs” or “Agreement”) constitute and govern the contractual relationship between the parties‚ Afrilotto Systems Limited hereinafter referred to as “AFRILOTTO” or “We”‚ “Us”‚ or “Our”; and "You"‚ as the user and customer‚ hereinafter referred to as “Player” or “You” or “Yours”.

“Operator” and “AFRILOTTO” in these General Terms and Conditions refers to Afrilotto Systems Limited‚ a company incorporated in Ghana with registration number CS017410222 licenced to operate certain games with the express approval of the NLA under number PLN_6/57JKPTASL011122. “National Lottery Authority” or “NLA” means the regulatory body in Ghana responsible for organizing raffles and lotteries in Ghana‚ as per Regulation 21 of the Lottery Regulations 2008 (LI 1948) of the Laws of Ghana.

“Player” means any individual or entity that expressly or impliedly agrees to all these General Terms and Conditions when playing the 6/57 style lottery game Lucky 70m (“Lucky 70m”) and certain electronic scratch games (together the “Games”) as further described below under the heading “GAME DETAILS”.

The Terms & Conditions (Ts&Cs) contained herein outlines the responsibilities that the Operator and the National Lottery Authority (NLA) bears and covers the governing rules for Players‚ user requirements‚ applicable user rights‚ user responsibilities and gameplay restrictions as captured for the Games. By playing the Games the Player acknowledges reading and understanding the governing rules of the Games and accepts to be bound by the Terms and Conditions set.

REVISIONS TO TERMS AND CONDITIONS

Operator reserves the right to effect changes to Terms and Conditions at any time it deems fit and without prior notice to players. Update to Ts&Cs will be reflected via in-game play or respective online channels (Operator website and/or Social Media handles). Player’s continued use of the Gamesindicates Player’s acceptance of changes.

COPYRIGHT

All game content contained in either gameplay‚ communication material‚ related software or hosted on 3rd party platforms‚ is and remains the property of the Operator and its affiliates and is duly protected by copyright law. None of the content may be reproduced‚ published‚ transmitted‚ distributed‚ displayed‚ modified or exploited in any way‚ in whole or in part without the prior written consent of the Operator or its affiliates or unless authorized under these Terms and Conditions.

TRADEMARKS

The name "Lucky 70m"‚ and all associated lottery game names and references‚ as well as the electronic scratch games‚ the technical platform‚ related software and all other graphics and logos displayed across all communication channels/platforms remain the sole property or have been licensed for use by the Operator (or National Lottery Authority) and without the express prior written permission of the Operator or the NLA (as the case may be)‚ may not be used at any time in any form (including but not limited to advertising‚ as an endorsement for any product or service‚ or any other purpose‚ commercial or otherwise).

LINKS

Operator or its affiliates may‚ from time to time‚ provide referral links or drive awareness for prospective players to access the the Games. Operator is not responsible for the activities of other unauthorized links or any communication material content not sanctioned by the Operator or its affiliates. Operator and its affiliates provide these links only as additional resources for the Players and make no representations regarding the content of any linked web site‚ shortcode or any companies that own‚ control or manage these channels. Consequently‚ Operator will not be‚ in any way or form‚ responsible for the accuracy‚ relevance‚ copyright compliance‚ legal conditions or decency of material contained in‚ programs used by‚ or services or products offered by‚ external channels not sanctioned by the Operator nor its affiliates

SMS / ADVERTISEMENTS

Operator or its affiliates may provide SMS based messaging services to notify users on all transactions performed on the Games Promotional activities via SMS (text messages)‚ traditional media (TV‚ Radio‚ Billboard‚ Online‚ Social Media etc)‚ BTL activations and other advertising channels will be employed to promote the Games. The Player by playing the the Games acknowledges and accepts to receive all communication and promotional content governing gameplay.

FEEDBACK

Any comments or materials sent or transmitted‚ including but not limited to‚ via electronic mail‚ standard mail‚ social media post‚ phone calls‚ SMS (text messages) or other communication channel to the Games regarding any content or information found in the Games‚ including‚ without limitation‚ data‚ questions‚ comments or suggestions (collectively referenced as "Feedback")‚ which will not be treated as confidential‚ will become the property of the Operator and may be subject to disclosure under certain laws. The Operator has no obligation of any kind with respect to Feedback and will be free to reproduce‚ use‚ disclose‚ exhibit‚ display‚ transform‚ distribute‚ and create derivative works from Feedback.

SECURITY OF SALES CHANNELS FOR THE GAMES

Please be advised that Operator and its associates cannot accept and are not responsible for any unauthorized access to your phone that results in gameplay on the Games. Operator takes steps to preserve the privacy of personal information and gameplay security‚ kindly review the Operator’s Privacy Policy for more information about how Operator handles personal information (such policy is provided below).

ELIGIBILITY

The Games are restricted to Players above the age of 18 years‚ physically present and residing in the Republic of Ghana while playing the game and owning mobile money accounts linked to the same phone used in playing across any of the local mobile networks (i.e. MTN‚ Vodafone‚ AirtelTigo). Playing the Games indicates an understanding of all the rules and regulations of such Games and provides consent to be bound by all terms and conditions of the Games. Operator and its affiliates reserve full rights to change any terms and conditions without prior notice and Players will abide by the same.

GAME DETAILS

Lucky 70m - CLASSIC (PERM and DIRECT):

Lucky 70m - CLASSIC is an NLA-approved game that allows players to select at least one out of fifty seven balls numbered 1-57. A draw is held every Friday commencing 30 December 2022 (unless otherwise advised) to randomly select 6 out of the 57 balls. If the numbers on the 6 selected balls match all of the numbers selected by the player at the time of play‚ he is a winner subject to the precise rules set out below. The bet types‚ stake amounts‚ prizes available and method of sharing certain prize categories in the event of multiple winners are set out below:

Lucky 70m - MEGA:

Lucky 70m - MEGA is an NLA-approved game that allows players to select six out of fifty seven balls numbered 1-57. A draw is held every Friday (unless otherwise advised) to randomly select 6 out of the 57 balls. If the numbers on the 6 selected balls match at least two of the numbers selected by the player at the time of play‚ he is a winner. The bet types‚ stake amounts‚ prizes available and method of sharing certain prize categories in the event of multiple winners are set out below:

The First Tier (jackpot) prize for Lucky 70m is capped at GHS 70‚000‚000 per draw and if there are multiple winners the GHS 70‚000‚000 is shared across both Lucky 70m – CLASSIC and Lucky 70m – MEGA. Under no circumstances will the Operator payout more than GHS 70‚000‚000 in aggregate across Lucky 70m – CLASSIC and Lucky 70m – MEGA for any single draw. Maximum eligible First Tier Prizes amounts for bets at less than GHS20 are reduced pro-rata based on the actual bet amount.

1. If there is only one winning entry in the Tier One category of both CLASSIC and MEGA and such winning entry is entered at full value (defined as a bet of GHS20)‚ the relevant prize amount shall be paid out in full to the winner (i.e. GHS70‚000‚000).
2. If there is only one winning entry in the Tier One category of both CLASSIC and MEGA‚ and such winning entry is entered at a fraction of the full value‚ the relevant prize amount available shall be multiplied by the fraction that the amount actually bet by the winner bears to GHS20 and such winning player shall be paid the resultant fraction of GHS70‚000‚000.

In the event there are multiple winners of the First Tier prize the prize shall be shared amongst all winners based on the sharing methodology defined below:

1. Each possible bet entry amount (currently 20 categories being the range between GHS1-20 in increments of GHS1) is treated as a distinct prize pool with respect to Tier One prizes only (a “Prize Pool Unit”)
2. If there is a winning ticket or winning tickets for the Tier One prize‚ the total amount of the Tier One prize to be paid out by the Operator (“Tier One Payable Total”) is calculated as the lesser of the sum of [the number of winning entries in each Prize Pool Unit] x [the per entry bet amount for each Prize Pool Units that have winners/GHS20] and GHS70‚000‚000.
   e.g.
   - if there was 1 winning ticket in Prize Pool Unit GHS10 and 5 winning tickets in Prize Pool Unit GHS1 then 75% of GHS70‚000‚000 would be paid out by the Operator to all Tier One winners in aggregate
   - if there was 2 winning ticket in Prize Pool Unit GHS10 and 5 winning tickets in Prize Pool Unit GHS1 then since 125% of GHS70‚000‚000 is greater than GHS70‚000‚000 just GHS70‚000‚000 would be paid out by the Operator to all Tier One winners in aggregate
3. The Tier One Payable Total as calculated above is allocated to each Prize Pool Unit that has winning tickets pro-rata to [the number of winning entries in each Prize Pool Unit] x [the per entry bet amount for each Prize Pool Units that have winners/GHS20]
   e.g.
   - if there was 1 winning ticket in Prize Pool Unit GHS10 and 5 winning tickets in Prize Pool Unit GHS1 then 67% of Tier One Payable Total would be paid to Prize Pool Unit GHS10 and 33% would be paid to Prize Pool Unit GHS1
   - if there was 2 winning ticket in Prize Pool Unit GHS10 and 5 winning tickets in Prize Pool Unit GHS1 then 80% of Tier One Payable Total would be paid to Prize Pool Unit GHS10 and 20% would be paid to Prize Pool Unit GHS1

The Tier One Prizes are shared equally between all winners within each Prize Pool Unit

For example:

1. One winner of Lucky 70m – MEGA only; stake of GHS10. The winner receives GHS35m (total payout = GHS35m)
2. Three winners of Lucky 70m – MEGA; 1 x GHS10‚ 1 x GHS5‚ 1 x GHS1. The winners will be entitled to GHS35.0m‚ GHS17.5m and GHS3.5m respectively (total payout = GHS56.0m)
3. Three winners of Lucky 70m – MEGA; 1 x GHS10‚ 1 x GHS5‚ 1 x GHS1 and one winner of Lucky70m – CLASSIC at stake of GHS10. The winners will be entitled to GHS26.9m‚ GHS13.5m‚ GHS2.7m and GHS26.9m respectively (total payout = GHS70.0m)
4. Three winners of Lucky 70m – MEGA; 1 x GHS5‚ 2 x GHS1. Each winners will be entitled to GHS17.5m and GHS3.5m each respectively (total payout = GHS25.0m)
5. One winner of Lucky 70m – MEGA at stake of GHS10 and one winner of Lucky70m – CLASSIC at stake of GHS10. The winners receive GHS35m each (total payout = GHS70m)

Players of the Lucky 70m games (CLASSIC and MEGA) must ensure that their bets are placed no later than 30 minutes before the draw.

INDEMNITY

Players shall indemnify and hold harmless AFRILOTTO and its affiliates (and their respective directors‚ officers‚ agents‚ Games Service Providers and employees) from and against any and all losses arising out of‚ relating to or in connection with the playing of the Games‚ except to the extent any such loss arises from AFRILOTTO’s intentional breach‚ fraud‚ gross negligence or wilful misconduct.

DRAW RESULTS

The draw of Lucky 70m shall be supervised by the NLA. The results of the electronic scratch games shall be from a third-party RNG that has been tested and accredited as to its randomness by an international testing laboratory.

THIRD-PARTY CHARGES & OMISSIONS

Transaction Charges when depositing or withdrawing money from the Player’s wallet:

Players may be charged per transaction based on the payment channel used. A Player shall bear the cost of transaction from these payment channels.

Third Party Omissions:

AFRILOTTO is not liable for transmission errors. Therefore‚ there shall be no claims for compensation due to any transmission errors‚ delays‚ or the misuse or manipulation of data.

PAYMENT OF WINNINGS

For players on mobile and web channels‚ smaller wins are automatically paid into their wallet. For larger prizes‚ such threshold set from time to time by the Operator but always including First Tier prize wins‚ Player KYC and AML checks shall be conducted to the Operator’s satisfaction in accordance with applicable laws from time to time before any winnings are paid either directly to the Player’s wallet or via other means.

In retail channels smaller wins can be collected from retailers but for larger prizes‚ such threshold set from time to time by the Operator but always including First Tier prize wins‚ Player KYC and AML checks shall be conducted to the Operator’s satisfaction in accordance with applicable laws from time to time before any winnings are paid to the winning Player.

INVALID FIRST TIER WINNINGS & UNCLAIMED FIRST TIER WINNINGS

Invalid First Tier winnings (e.g. fraudulent‚ under-age and connected party such as an employee of Operator winners) will not be paid any First Tier winnings and any such win will be deemed invalid and not to be a win.

If a First Tier prize remains unclaimed for more than 6 months from the date of the relevant draw‚ such winnings shall be deemed an unclaimed First Tier winnings and shall be remitted to the unclaimed prize fund of the NLA in full.

WRONGFULLY AWARDED WINNINGS

Operator reserves the right to reclaim any winnings which were paid to Player by Operator in good faith but which are subsequently found to be wrongfully paid out for any reason whatsoever (for example identity fraud perpetrated by a Player). There is no time limit on when the wrongfully awarded winnings can be reclaimed by Operator and Player acknowledges by playing the Games that Player agrees to this provision.

DECLARATION

I am 18 years old or older. I am physically present and residing in the Republic of Ghana while playing the Games. I am not an employee/shareholder/director/consultant to/family member of Operator or its affiliates‚ NLA or its affiliates‚ any third party supplier of Operator or any such potentially conflicted person. I have understood all rules and regulations of the Games. I agree with all the terms and conditions herein. I acknowledge that Operator has full rights to change any term or condition without prior notice to me and I will abide by the same.

The Games are available to‚ and may only be used by individuals‚ who can enter into legally binding contracts under the law applicable to Ghana. I certify that I qualify and meet this requirement. In all circumstances‚ AFRILOTTO shall not be held responsible for misuse of the services by any unauthorized parties or minors.

AFRILOTTO may amend and/or assign this Agreement or any rights and/or obligations from time to time. Any changes to the General Terms and Conditions will be communicated to the Player beforehand by updating the website and/or retail venues where the Games can be played. By continuing to play the Games‚ the Player agrees to be bound by the Ts&Cs as well as by the latest modifications to it. If a player does not agree to be bound by the changes to these Ts&Cs‚ the Player must not use or access AFRILOTTO’s sales channels and or play the Games. In order to avoid misunderstandings and disputes at a later stage‚ Players can print out these Ts&Cs.

EXECUTION OF THIS AGREEMENT

This Agreement shall be governed by and interpreted in accordance with the laws of Ghana‚ excluding that body of law pertaining to conflict of laws. Any legal action or proceeding arising under this Agreement will be brought exclusively in the courts of Ghana‚ and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

FORCE MAJEURE

AFRILOTTO will not be liable in any way to any persons in the event of force majeure‚ or for the act of any government or legal authority.

OTHER TERMS AND CONDITIONS

Employees‚ consultants‚ shareholders or directors of AFRILOTTO‚ NLA and/or their suppliers‚ as well as family members of the aforementioned parties‚ are prohibited from playing the Games. Any indication of fraud‚ manipulation‚ cash-back arbitrage‚ or other forms of deceitful or fraudulent activity which is the basis of a provision of a bonus or otherwise will render the Account inactive along with any and all profits or losses gathered.

AFRILOTTO will treat as highly confidential the information the Player entrusts to it‚ in accordance with its Privacy Policy.

AFRILOTTO may waive a right or provision from these General Terms and Conditions in particular cases.

AFRILOTTO will not be bound by‚ and the Player has no claim for‚ a waiver of such right or provision in future matters. Any suspicious or fraudulent transactions will be immediately reported to the relevant authorities.

By playing the Games the Player is acknowledging that he or she is at the risk of losing money. It is the Player’s sole responsibility to assume any losses suffered as a result of staking this game. All transactions have to be processed in accordance with Ghana’s anti-money laundering regulations.

AFRILOTTO reserves the right‚ in its sole discretion‚ to void and not pay the Player any winnings‚ to terminate the Agreement‚ to refuse‚ cancel the services‚ and/or refuse to distribute profits to anyone for any legitimate reason including‚ but not limited to:

1. The Player provides incorrect or misleading information on his/her mobile money account.

2. The Player has neglected or has failed to provide the required identification documents.

3. The Player provides documents which do not match with the data from mobile money account data.

4. The Player resides in or uses or accesses the Game from a jurisdiction other than Ghana.

5. The Player uses money gained through criminal‚ unauthorized or other illegal activities.

6. The Player is not of legal age (at least 18 years old).

7. The Player has defrauded or attempted to defraud AFRILOTTO‚ its affiliates‚ or any other party in any way. This includes any system based on the use of software‚ techniques‚ computer‚ machines or similar tools or the establishment of a syndicate of Players in order to defraud or to cause damage to AFRILOTTO‚ its Players or any other party.

8. The Player has allowed or permitted access to a third party to his/her mobile money account to attempt to defraud or to cause damage to AFRILOTTO‚ its Players or any other party. AFRILOTTO makes no exception for intentionally or unintentionally actions or reasons.

9. The Player violates any terms of the Agreement or fails to comply with it. The list of reasonable grounds above is not exhaustive.

10. The Player is an employee‚ consultant‚ shareholder or director of AFRILOTTO‚ NLA and/or their suppliers or is a family members of the aforementioned parties.

The Player expressly authorizes AFRILOTTO to make payment of wins directly to mobile money account used by the Player to play the Games and shall hold AFRILOTTO harmless of any loss or problems arising out of payment of wins to this mobile money account used by the Player to play the Games.

The term of the Agreement shall be for an indefinite period and should the Player wish to terminate this Agreement at any time‚ he/she may discontinue from playing the Games.

COMMITMENT TO DISCUSSIONS

In the event of a dispute in respect of the Games or the payment or awarding of any winnings‚ AFRILOTTO may withhold payment of the Games winnings until any dispute has been fully resolved.

MISCARRIED AND ABORTED GAMES/STAKES

AFRILOTTO takes every precaution to avoid as much as possible‚ any technical anomaly or problem. However‚ this is not always possible. Consequently;

1. AFRILOTTO‚ Our suppliers and/or licensors are not liable for any downtime‚ server disruptions‚ lagging‚ or any technical or political disturbance to the gameplay. Refunds may be given solely at the discretion of the management;

2. AFRILOTTO‚ Our suppliers and/or licensors accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with our website game play channel or its content‚ including and without limitation to:

1. Delays or interruptions in operation or transmission;

2. Loss or corruption of data;

3. Communication or lines failure;

4. Any site or content misuse;

5. Any errors or omissions in content;

If a lottery draw does not take place‚ all valid stakes shall be refunded to Players.

If the Games malfunction because of a failure of the system‚ We shall refund the amount wagered in Your game by crediting it to Your mobile money account or‚ if Your mobile money account no longer exists‚ by paying it to You directly‚ in an approved manner.

PRIVACY POLICY

By playing the Games with AFRILOTTO‚ the Player implicitly gives his authorization to the processing of any personal data in compliance with the privacy laws in force in Ghana for the use of the mobile or online lottery or games or betting offered by AFRILOTTO.

The supply of data to third parties is on an ‘opt-in’ basis. By playing the Games with AFRILOTTO and through the voluntary interaction Players undertake with AFRILOTTO products‚ the Player confirms and agrees that they consent to the use of all or part of the information they supply‚ the transactions they undertake through it and the interactions which they perform with AFRILOTTO and on behalf of AFRILOTTO.

All interactions the Player undertakes with AFRILOTTO will be stored by AFRILOTTO for the purposes of record and as such may be employed by AFRILOTTO in such cases where disputes arise between Players and AFRILOTTO.

AFRILOTTO will do its utmost to ensure the confidentiality of its Players’ personal information including the implementation of data protection procedures designed to ensure user confidentiality.

AFRILOTTO ensures that its data protection policy is regularly updated in order to ensure that the Player's information is continually safeguarded. From time to time‚ AFRILOTTO may contact Players either via phone‚ SMS or otherwise for the purpose of offering them further information about AFRILOTTO.

In addition‚ AFRILOTTO may‚ on occasion‚ seek to contact Players‚ either by phone‚ SMS or otherwise‚ for the purpose of informing them on unique promotional offerings provided by AFRILOTTO for its Players.

Players consent to the receipt of such contact when they consent to our General Terms and Conditions when playing the Games with AFRILOTTO. Any person wishing to opt-out of further contact with AFRILOTTO must contact customer support.

AFRILOTTO may be required by law or relevant authorities to disclose data of Players.

If AFRILOTTO believes that disclosure is necessary‚ AFRILOTTO will disclose the information to the relevant public authorities in Ghana. Any suspicious or fraudulent activities can be immediately reported to the relevant authorities‚ including but not limited to the MGA.

AFRILOTTO reserves the right to publish the name of a Player who wins a significant amount. Consequently‚ by agreeing to these terms and conditions‚ You are hereby agreeing to have your first name and the first letter of your surname published on the AFRILOTTO website and/or through social networks in the case of significant wins.

AFRILOTTO shall not disclose your full name in public unless we receive your authorization to do so as part of the prize awarding ceremony.

COMPLAINTS

In case of a complaint or an issue‚ a player is to contact customer support and detail the nature of the complaint.

AFRILOTTO customer care representatives shall address and resolve complaints instantly or escalate to appropriate units or parties for it to be resolved. There are no time limits for resolving Players’ complaints.

SEVERABILITY CLAUSE

Each clause contained in these General Terms and Conditions shall be separate and severable from each of the others. If any clause is found to be void‚ invalid‚ or unenforceable for any reason whatsoever‚ the remaining clauses shall remain in full force and effect.
